The provisions below constitute a contract establishing the general terms and conditions for the distance selling of the products of the KABIOCA.com e-commerce site concluded between:

  1. PRICE

Prices are quoted in euros all taxes included. The prices are those in force on the day of the order. They take into account the VAT applicable on the day of the order. Any change in the VAT rate will be reflected automatically on prices. 
For any delivery outside the territory of the European Union, customs taxes and formalities are, unless otherwise indicated, the exclusive responsibility of the customer who undertakes to check the possibilities of importing products in the country of delivery.

  1. ORDERS

Placing an order implies full and irrevocable acceptance by the Customer of these general conditions of sale. Any order by the Customer constitutes acceptance of the prices and description of the products available for sale. The sale will not be considered final until the Customer has sent the confirmation of the order by KABIOCA.com and the latter has received the full price. The site's automatic registration systems are considered as proof of the sales contract and its date. KABIOCA.com undertakes to honor orders received on the website only within the limits of available stocks of products. In the absence of product availability, KABIOCA.com undertakes to inform the Customer as soon as possible.

  1. PAYMENTS
  • Perfect Credit Card : The validation of the order by means of the credit card number and the expiry date is warranted to pay the total amount of the order. The data relating to the bank card are only kept during the order processing time (secure communication protocol).
  • Perfect PayPal : PayPal is the world leader in online payments. PayPal encrypts and protects your card number, PayPal allows you to pay online without disclosing your financial information during the transaction, we do not save credit card details under any circumstances.
  • By bank transfer: Our bank details are indicated when you confirm your order on the site. Your order will be shipped upon receipt of the transfer.

Acceptance of the order and its processing will only be effective upon receipt of payment.

  1. CONFIRMATION

The following contractual information will be the subject of a confirmation e-mail after validation of the order by the customer containing the following information: 

• The unique order number
• The total amount of the order, its price including VAT or tax and the amount of delivery charges

• The delivery adress
• The identity and references of the merchant

  1. EXECUTION

The order duly accepted by KABIOCA.com under the conditions set out in point 4 of these General Terms and Conditions of Sale will be executed within 2 days at the latest (this is a maximum period, orders usually being processed on the same day). In case of unavailability of the ordered product, the Customer will be informed as soon as possible and will have the possibility to cancel his order. He will then have the choice of requesting either the exchange of the product or the reimbursement of the sums within 30 days from the date of the request.

  1. FAST DELIVERY

All orders will be delivered in a closed, solid and discreet sending to the address indicated by the Customer. Only settled orders will be shipped. In addition, KABIOCA.com reserves the right to refuse any order from a customer with whom an ongoing dispute exists. Upon delivery, the Customer is required to check the condition of the packaging and merchandise and in case of damage, to make reservations immediately on the voucher, as well as KABIOCA.com Customer Service by e-mail, or using the contact form.
In case of return of the package for any reason whatsoever, the customer is notified by email. Without a response from him within 15 days of sending this email, the package will be considered abandoned.

  1. SHIPPING

Deliveries are made via independent carriers but always have a tracking number to track the delivery of your package.
The shipping costs represent the shipping and insurance costs, which are calculated according to the weight of the products and our packaging costs. No complaint after receipt can be received by KABIOCA.com after receipt of the package on the amount of shipping costs.

Our carrier is the post office (Colissimo). The tracking numbers are sent to you with the shipping notification automatically by our system.

  1. WARRANTY

In the event of non-compliance or defect of the delivered product, the Customer must inform KABIOCA.com Customer Service by e-mail (get in touch), which undertakes to remedy the problem as soon as possible. In any event, KABIOCA.com assumes with regard to the Customer, the responsibility relating to the products delivered in accordance with the regulations in force, and therefore guarantees the latter against any claim or claim, judicial or amicable, resulting both damage to property and damage to people, as a result of said products. KABIOCA.com also guarantees, in accordance with legal provisions, the Customer against any hidden defect affecting the products delivered and rendering them unfit for use, as well as the resulting damaging consequences. All our items are guaranteed for 14 days from the date of purchase. Only items in their original packaging are taken back. The shipping costs will remain the responsibility of the applicant.

  1. RETRACTION TIME

Pursuant to the provisions of articles L 121-16 et seq. Of the Consumer Code, the consumer has a withdrawal period allowing him to renounce his purchase within 14 clear days of delivery. It is imperative that he first express his intention to return the package as part of the exercise of his right of withdrawal by contacting us via our contact form.   1. RETURNS

The return is made ONLY after a return request requested via our Contact form and after having explained its reason. The consumer has 14 clear days from receipt of the package to make his request. Only perfectly intact product returns are accepted (with the exception of returns motivated by a product malfunction).
No return of article can be accepted without request and agreement beforehand by email.
The risks of transport are entirely the responsibility of the sender, and it is therefore his responsibility to carry out all due diligence regarding the security of the delivery, in particular by ensuring its shipment. Return costs are entirely the responsibility of the sender, except in the event that the return is motivated by an error on the part of the KABIOCA.com company in the preparation of the order. If, for any reason, one of these terms and conditions should be declared inapplicable, this inapplicability would not affect the application of the other provisions of the general conditions, the one deemed inapplicable being then replaced by the closest possible provision.

  1. RESPONSIBILITY

Neither KABIOCA.com, nor the Customer, can be held responsible for any non-compliance resulting from a case of force majeure, beyond their control, including but not limited to cases of war, riot, insurrection, interruption of transport, import or export problem, strike, shortage, fire, earthquake, storm, flood. The Customer is solely responsible for the choice of products, their storage and their use by himself or by a third party.

  1. DISPUTES, APPLICABLE LAW AND MEDIATION OF CONSUMPTION

Any dispute relating to the execution of an order and / or the interpretation of these general conditions, is subject to French law.

In the event of a dispute relating to the interpretation or execution of agreed agreements, an amicable solution will be sought before any legal recourse.
