General Terms & Conditions

  1. OBJECT

The provisions below constitute a contract establishing the general conditions of distance selling of products from the KABIOCA.com e-commerce site concluded between:
a merchant registered in France and a consumer in the context of a distance selling system.

  1. PRICE

Prices are quoted in euros all taxes included. The prices are those in force on the day of the order. They take into account the VAT applicable on the day of the order. Any change in the VAT rate will be reflected automatically on prices.
For any delivery outside the territory of the European Union, customs taxes and formalities are, unless otherwise indicated, the sole responsibility of the customer who undertakes to check the possibilities of importing the products into the country of delivery.

  1. ORDERS

Placing an order implies full and irrevocable acceptance by the Customer of these general conditions of sale. Any order by the Customer constitutes acceptance of the prices and description of the products available for sale. The sale will only be considered final after the order confirmation has been sent to the Customer by KABIOCA.com and the full price has been collected by the latter. The site's automatic registration systems are considered proof of the sales contract and its date. KABIOCA.com undertakes to honor orders received on the website only within the limits of available product stocks. If the product is not available, KABIOCA.com undertakes to inform the Customer as soon as possible.

  1. PAYMENTS

  • By Credit Card: The validation of the order by means of the credit card number and the expiry date is worth mandate to pay the total amount of the order. Data relating to the credit card are only kept during the time the order is processed (secure communication protocol).
  • By PayPal:PayPal is the world leader in online payments. PayPal encrypts and protects your card number, PayPal allows you to pay online without disclosing your financial information during the transaction, we do not store credit card details in any way.
  • By bank transfer: Our bank details are indicated to you when you confirm your order on the site. Your order will be shipped upon receipt of the transfer.

The acceptance of the order and its processing will only be effective upon receipt of payment.

  1. CONFIRMATION

The following contractual information will be the subject of a confirmation e-mail after validation of the order by the customer containing the following information:

• The unique order number
• The total amount of the order, its price including VAT or tax and the amount of delivery charges
• The payment method chosen by the Client
• The delivery adress
• The merchant's identity and references

  1. EXECUTION

The order duly accepted by KABIOCA.com under the conditions mentioned in point 4 of these General Terms and Conditions of Sale will be executed no later than within 2 days (this is a maximum period, orders are usually processed the same day). In case of unavailability of the product ordered, the Customer will be informed as soon as possible and will have the possibility of canceling his order. He will then have the choice of requesting either the exchange of the product or the reimbursement of the sums within 30 days from the date of the request.

  1. SHIPPING DETAILS

All orders will be delivered in a closed, solid and discreet shipment to the address indicated by the Customer. Only paid orders will be shipped. Furthermore, KABIOCA.com reserves the right to refuse any order from a customer with whom an ongoing dispute exists. On delivery, the Customer is required to check the condition of the packaging and the goods and in the event of damage, to make reservations immediately on the transport voucher, as well as to KABIOCA.com Customer Service by email, or using the contact form.
In case of return of the package for any reason whatsoever, the customer is notified by email. Without a response from him within 15 days following the dispatch of this email, the package will be considered abandoned.

  1. SHIPPING

Deliveries are made via independent carriers but always benefit from a tracking number in order to be able to follow the delivery of your package.
Postage costs represent postage and insurance costs, which are calculated according to the weight of the products and our packaging costs. No complaint after receipt can be received by KABIOCA.com after receipt of the package on the amount of shipping costs.

Our carrier is the post office (Colissimo). Tracking numbers are sent to you with the shipping notification automatically by our system.

  1. WARRANTY

In the event of non-compliance or defectiveness of the product delivered, the Customer must inform KABIOCA.com Customer Service by e-mail (contact), which undertakes to remedy the problem as soon as possible. In any case, KABIOCA.com assumes with regard to the Customer, the responsibility relating to the products delivered in accordance with the regulations in force, and guarantees, consequently, this one against any complaint or claim, legal or amicable, resulting both damage caused to property and damage caused to persons, as a result of said products. KABIOCA.com also guarantees, in accordance with legal provisions, the Customer against any hidden defect affecting the products delivered and rendering them unsuitable for use, as well as any harmful consequences resulting therefrom. All our items are guaranteed for 14 days from the date of purchase. Only items in their original packaging are taken back. Shipping costs will remain the responsibility of the applicant.

  1. RETRACTION TIME

Pursuant to the provisions of Articles L 121-16 and following of the Consumer Code, the consumer has a withdrawal period allowing him to cancel his purchase within 14 clear days of delivery. He must imperatively announce beforehand his intention to return the parcel within the framework of the exercise of his right of withdrawal by contacting us via our contact form. The products must not have been used, they must be returned to the company KABIOCA.com at the expense of the consumer and under his responsibility, it is up to him to carry out the transport insurance, in perfect condition for resale, in their packaging original and showing no signs of shock or malfunction. Consumable products are taken back and exchanged only if they are in perfect condition and unopened. Subject to compliance with the above provisions, KABIOCA.com will refund the products ordered for the amount shown on the order form (the return costs are borne by the customer) within 14 working days of receipt of the products (legal deadline). No refund can take place if the products are not in their original packaging, which must be perfectly intact. Pursuant to Articles L 121-16 and following of the Consumer Code, professionals cannot claim either the right of withdrawal or the “satisfied or refunded” guarantee.

  1. RETURNS

The return is made ONLY after a return request requested via our Contact form and after having explained its reason. The consumer has 14 clear days upon receipt of the package to make his request. Only returns of perfectly intact products are accepted (with the exception of returns motivated by a malfunction of the product).
No return of item can be accepted without prior request and agreement by email.
The risks of transport are entirely the responsibility of the sender, and it is therefore up to him to carry out all due diligence as to the security of the routing, in particular by insuring its dispatch. The return costs are entirely the responsibility of the sender, except in the case where the return is motivated by an error by KABIOCA.com in the preparation of the order. Any return of product concerning a product not being correctly packed, whose packaging would have been opened or which after examination would not prove to be defective, cannot be accepted. It will then be up to the sender to recover his package at his own expense.

  1. INFOS

The information requested from the Customer is necessary for the processing of his order and cannot be communicated to third parties. In accordance with the French law "Informatique et Libertés" of January 6, 1978, the Customer may object to such communication and has the right to access, modify, rectify and delete personal data concerning him. KABIOCA.com guarantees that the cryptology means and services used to secure transactions have been authorized or declared in application of the legislation in force.

  1. SIGNATURE & PROOF

The validation of the order associated with the authentication procedure and the protection of the integrity of the messages constitutes an electronic signature having between the parties the same value as a handwritten signature. The computerized registers, kept in the computer systems of KABIOCA.com under reasonable security conditions, will be considered as proof, communications, orders and payments made between the parties. Archiving of orders and invoices is carried out on a reliable and irreversible medium so as to correspond to a faithful and durable copy, in accordance with article 1348 of the civil code.

  1. INTELLECTUAL PROPERTY

All texts, comments, works, illustrations, photos and images reproduced on the sites published by KABIOCA.com are reserved under copyright as well as intellectual property and for the whole world. As such and in accordance with the provisions of Intellectual Property Code, only the use for private use is authorized subject to different or even more restrictive provisions of the intellectual property code. Any other use constitutes counterfeiting and is sanctioned under Intellectual Property unless prior written authorization from KABIOCA.com. Any total or partial reproduction of the sites published by KABIOCA.com is strictly prohibited.

  1. INTEGRALITY OF THE CONTRACT

If, for any reason, one of these general conditions should be declared inapplicable, this inapplicability will not affect the application of the other provisions of the general conditions, the one deemed inapplicable being then replaced by the closest possible provision.

  1. RESPONSIBILITY

Neither KABIOCA.com nor the Customer shall be held responsible for any non-performance resulting from a case of force majeure, beyond their control, including in particular, without limitation, cases of war, riot, insurrection, transport disruption, import or export problem, strike, shortage, fire, earthquake, storm, flood. The Customer is solely responsible for the choice of products, their conservation and their use by himself or by a third party.

  1. DISPUTES, APPLICABLE LAW AND MEDIATION OF CONSUMPTION

Any dispute relating to the execution of an order and / or the interpretation of these general conditions, is subject to French law.

In the event of a dispute relating to the interpretation or execution of agreed agreements, an amicable solution will be sought before any legal recourse.

In accordance with the provisions of articles L 611-1 and R 612-1 and following of the Consumer Code concerning the amicable settlement of disputes: When the consumer has sent a written complaint to the professional and he has not obtained satisfaction or reply within two months, he can submit his complaint free of charge to the consumer mediator. The mediator must be contacted within a maximum period of one year from the initial complaint.
